Welcome to LandedSafe. This document contains both our Privacy Policy and our Terms of Service. By using LandedSafe (the "Service"), you agree to both. If you do not agree, do not use the Service.

LandedSafe is operated by LandedSafe ("we," "us," "our"). The Service is provided free of charge and is offered "as is" without warranties of any kind. LandedSafe provides automated flight tracking notifications and an AI-powered post-landing assistant for general aviation pilots. LandedSafe is not an FAA-approved service, does not provide air traffic control services, and is not a substitute for proper flight planning, weather briefings, or pilot judgment.

Part 1: Privacy Policy

1. Information We Collect

1.1 Information You Provide

When you use LandedSafe, you may provide us with:

  • Aircraft tail number (N-number)
  • Your mobile phone number
  • Destination airport (optional)
  • Speed and vertical speed threshold preferences
  • Recipient names and phone numbers (when you add contacts to receive flight notifications)
  • Email address and name (if you create an optional account)
  • SMS messages you send to our AI assistant

1.2 Information We Collect Automatically

When you use the Service, we automatically collect:

  • Flight tracking data from ADS-B (Automatic Dependent Surveillance-Broadcast) sources, including aircraft position, altitude, ground speed, vertical speed, heading, and departure/arrival airports
  • SMS delivery and interaction data (message timestamps, delivery status)
  • IP address and device information when you visit our website
  • Usage data (pages visited, features used, form submissions)

1.3 Information from Third-Party Services

We may receive data from third-party services we integrate with, including:

  • ADS-B Exchange (flight position data)
  • Uber and Lyft (ride price estimates only; we do not receive your ride history or personal account data)
  • Aviation weather services (METAR/TAF data for airports)
  • Google OAuth (name and email, if you sign in with Google)

2. How We Use Your Information

We use the information we collect to:

  • Track your aircraft and detect takeoff and landing events
  • Send flight status notifications to you and your designated recipients via SMS and email
  • Provide AI-powered post-landing assistance, including FBO information, ground transportation options, weather briefings, and flight planning support
  • Send service request emails to FBOs on your behalf (only with your explicit confirmation)
  • Compare ride-share prices from Uber and Lyft for ground transportation
  • Maintain your account, saved aircraft, and saved recipients (if you create an account)
  • Improve the Service (using anonymized, aggregated data only)
  • Comply with legal obligations

3. What We Do Not Do With Your Information

We want to be clear about what we will never do:

  • We NEVER sell your personal information to anyone.
  • We NEVER share your data with third parties for marketing purposes.
  • We NEVER use your phone number for anything other than providing the LandedSafe service.
  • We NEVER provide your flight tracking data to advertisers, data brokers, or any third party for commercial purposes.

The only third parties that receive any of your data are the service providers necessary to operate LandedSafe (SMS delivery, email delivery, flight tracking data sources, and ride-share APIs for price estimates). These service providers are used solely to deliver the Service to you.

4. Data Retention

  • Active tracking sessions: Retained for the duration of the flight plus 30 days.
  • Flight history (for account holders): Retained for 30 days, then automatically deleted.
  • AI conversation logs: Retained for 30 days, then automatically deleted. Anonymized conversation data may be retained longer for service improvement.
  • SMS consent records: Retained for as long as required by applicable law (typically 4 years under TCPA best practices).
  • Account information: Retained until you delete your account or request deletion.
  • Notification delivery logs: Retained for 90 days for troubleshooting purposes.

5. Your Rights and Data Deletion

You have the right to:

  • Request a copy of the personal data we hold about you
  • Request deletion of your personal data
  • Opt out of SMS messages at any time by replying STOP
  • Delete your account and all associated data

6. Children's Privacy

LandedSafe is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at landedsafe.com/about and we will promptly delete it.

7. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including encryption of data in transit (HTTPS/TLS), encrypted database connections, secure API key management, and access controls. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy on our website and updating the effective date. Your continued use of the Service after any changes constitutes acceptance of the updated policy.

Part 2: Terms of Service

1. Acceptance of Terms

By accessing or using LandedSafe (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. By submitting the tracking form on our website, you specifically agree to:

  • These Terms of Service and the Privacy Policy above
  • The SMS opt-in and messaging terms described in Section 6
  • The limitation of liability and held harmless provisions described in Section 9
  • That LandedSafe is provided "as is" with no warranties of any kind
  • That you will not rely on LandedSafe for safety-critical decisions

2. Description of the Service

LandedSafe is a free flight tracking and post-landing assistant service for general aviation pilots. The Service includes:

  • Automated flight tracking using publicly available ADS-B data
  • Takeoff and landing notifications sent to you and your designated recipients via SMS and/or email
  • An AI-powered conversational assistant accessible via SMS that can help with FBO services, ground transportation, weather information, and flight planning
  • Optional email communications to FBOs on your behalf (sent only with your explicit confirmation)
  • An optional user account for saving aircraft, recipients, and viewing flight history

3. Cost and Payment

LandedSafe is completely free. There are no premium tiers, no paid features, no subscriptions, and no hidden costs. Standard message and data rates from your wireless carrier may apply to SMS messages.

We reserve the right to introduce advertising in the future to support the Service. Any future advertising will be clearly identified and will not involve sharing your personal data with advertisers.

4. User Accounts

Creating an account is optional. The core tracking service works without an account. If you create an account:

  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate information
  • You may delete your account at any time by visiting landedsafe.com/about

5. Adding Recipients

When you add recipients (people to be notified of your flights), you represent and warrant that:

  • You have obtained the prior consent of each recipient to receive SMS messages from LandedSafe on your behalf
  • You have the authority to provide each recipient's phone number to LandedSafe
  • The information you provide for each recipient is accurate
  • You understand that recipients will receive an introductory message identifying LandedSafe and providing the ability to opt out

LandedSafe is not responsible for verifying recipient consent. You assume full responsibility for adding recipients who have given you permission to share their contact information. If a recipient opts out, we will immediately cease sending them messages.

6. SMS Messaging Terms

6.1 Consent

By checking the SMS opt-in checkbox on the tracking form, you expressly consent to receive flight tracking notifications and AI assistant messages via SMS from LandedSafe. This consent is not a condition of any purchase (the Service is free).

6.2 Message Frequency

Message frequency varies depending on your flight activity and interaction with the AI assistant. Typical messages include: a welcome message, takeoff notification, landing notification, AI assistant responses to your questions, and recipient collection prompts. You control the frequency of AI assistant messages by how often you text us.

6.3 Message and Data Rates

Standard message and data rates from your wireless carrier may apply. LandedSafe does not charge for SMS messages.

6.4 Opting Out

You may opt out of all SMS messages at any time by replying STOP to any message from LandedSafe. Upon receiving STOP, we will immediately cease all SMS communications to your phone number and confirm your unsubscription.

6.5 Re-subscribing

If you have previously opted out, you may re-subscribe at any time by replying START to our number or by submitting a new tracking request on our website.

6.6 Help

For SMS support, reply HELP to any message from LandedSafe. You may also contact us at landedsafe.com/about.

6.7 No Data Sharing

We do not ever share your phone number or any personal data with third parties for marketing purposes.

7. AI Assistant

The LandedSafe AI assistant is a conversational tool designed to help pilots with post-landing logistics. You acknowledge and agree that:

  • The AI assistant may provide inaccurate, incomplete, or outdated information
  • The AI assistant's responses are not professional advice of any kind (not legal, financial, medical, aviation, or mechanical advice)
  • You are solely responsible for verifying any information provided by the AI assistant before acting on it
  • The AI assistant cannot and does not replace proper flight planning, weather briefings, or consultation with qualified professionals
  • Conversations with the AI assistant may be used in anonymized form to improve the Service

8. FBO Email Communications

The AI assistant can send emails to Fixed Base Operators (FBOs) on your behalf. You acknowledge and agree that:

  • All FBO emails will be shown to you via SMS and require your explicit confirmation before sending
  • FBO emails use intentionally vague, non-committal language (e.g., "the pilot may need fuel service" rather than specific fuel quantities)
  • You are responsible for confirming all specific service requests directly with the FBO upon arrival
  • LandedSafe is not responsible for the accuracy of any information in FBO emails, including but not limited to fuel prices, service availability, and operating hours
  • LandedSafe is not a party to any transaction between you and an FBO
  • You will be CC'd on every FBO email sent on your behalf

9. Disclaimers, Limitation of Liability, and Assumption of Risk

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9.2 Aviation-Specific Disclaimers

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • LandedSafe is NOT an FAA-approved or FAA-certified service.
  • LandedSafe does NOT provide air traffic control (ATC) services, flight following, or flight dispatch services.
  • LandedSafe does NOT replace proper flight planning, weather briefings, NOTAMs, TFR checks, or any other pre-flight or in-flight safety procedures.
  • LandedSafe does NOT provide aircraft maintenance advice. For all maintenance concerns, you must consult an FAA-certified Airframe and Powerplant (A&P) mechanic.
  • The pilot in command (PIC) remains solely and exclusively responsible for all flight decisions, including but not limited to go/no-go decisions, route planning, fuel planning, weather assessment, and compliance with all applicable Federal Aviation Regulations (FARs).
  • The emergency descent detection feature (vertical speed alerts) is advisory only and MUST NOT be relied upon as a primary safety system, emergency locator, or distress alerting mechanism.
  • ADS-B tracking has known limitations, including but not limited to: coverage gaps (especially at low altitudes and in remote areas), data latency (positions may be delayed by 30 seconds or more), aircraft that do not broadcast ADS-B, multilateration errors, and temporary system outages.

9.3 No Guarantee of Notification Delivery

WE DO NOT AND CANNOT GUARANTEE THAT ANY NOTIFICATION (SMS, EMAIL, OR OTHERWISE) WILL BE DELIVERED SUCCESSFULLY, ACCURATELY, OR IN A TIMELY MANNER.

Notification delivery depends on factors outside our control, including but not limited to: wireless carrier networks, SMS delivery infrastructure, cellular coverage at your location, your device settings, spam filters, carrier rate limiting, and third-party service provider uptime. You must not rely on LandedSafe notifications as your sole means of communicating flight status.

9.4 Third-Party Information

The Service incorporates information from third-party sources, including but not limited to: ADS-B flight data, FBO information and fuel prices, Uber and Lyft ride estimates, aviation weather data (METAR/TAF), and airport information. We do not control these third-party sources and make no representations or warranties about the accuracy, completeness, timeliness, or reliability of any third-party information. Fuel prices, FBO services, ride estimates, and weather data may be inaccurate, outdated, or incomplete.

9.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LANDEDSAFE, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES (COLLECTIVELY, THE "LANDEDSAFE PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE LANDEDSAFE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ZERO DOLLARS ($0.00), AS THE SERVICE IS PROVIDED FREE OF CHARGE.

9.6 Assumption of Risk and Hold Harmless

YOU EXPRESSLY AGREE TO HOLD HARMLESS AND INDEMNIFY THE LANDEDSAFE PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or reliance on the Service
  • Any inaccuracy, delay, or failure in flight tracking data
  • Any failure, delay, or inaccuracy of notifications (takeoff, landing, or otherwise)
  • Any information provided by the AI assistant
  • Any FBO email communications sent on your behalf
  • Any inaccuracy in third-party data, including fuel prices, ride estimates, weather data, and airport information
  • Any decisions you make based on information provided by the Service
  • Your addition of recipients without their consent
  • Any violation of these Terms by you
  • Any injury, death, property damage, or other loss arising from any cause whatsoever related to your use of the Service
  • Any claim by a recipient or third party arising from notifications sent on your behalf

YOU ACKNOWLEDGE THAT AVIATION IS AN INHERENTLY DANGEROUS ACTIVITY AND THAT LANDEDSAFE IS A CONVENIENCE TOOL ONLY. THE SERVICE IS NOT A SAFETY SYSTEM AND MUST NOT BE TREATED AS ONE.

10. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
  • Attempt to access another user's account or data
  • Submit false or misleading information (including fake tail numbers or phone numbers)
  • Use the Service to harass, stalk, or monitor any person without their knowledge and consent
  • Use automated tools (bots, scrapers) to access the Service beyond normal use
  • Resell, redistribute, or commercially exploit the Service or any data obtained from it
  • Add recipients who have not given you permission to share their contact information

11. Intellectual Property

The LandedSafe name, logo, website, and all associated content, features, and functionality are owned by LandedSafe and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the LandedSafe name, logo, or branding without our prior written consent.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections 9 (Disclaimers, Limitation of Liability, and Assumption of Risk), 11 (Intellectual Property), and 13 (Governing Law) survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida. You consent to the personal jurisdiction of such courts.

You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LandedSafe regarding the Service and supersede all prior agreements and understandings.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
